Terms and Conditions of Service – GPSGY

#1 – Ownership and Equipment Terms Tracker Ownership

Upon full payment, the GPS tracking device becomes the sole property of the customer. Customers are free to use the device with any compatible server or service provider. The device is non-refundable after installation is completed.

Installation
Installation services are offered at an additional cost, which varies depending on whether the installation includes the remote shutdown feature. Remote shutdown is only available for select vehicle models and must be confirmed before installation. Reinstallation, removal, or relocation services will also incur separate fees.

SIM Card and Server Access
The SIM card and server access provided with the GPS tracker are part of a monthly subscription service and remain the property of GPSGY at all times.

Subscription Requirement
Access to the GPS tracking platform and SIM data is conditional on an active monthly subscription. Without an active subscription, live tracking and historical data access may be limited or suspended.

Device Warranty
Devices come with a limited warranty of 6 months covering manufacturing defects only. Damage caused by misuse, improper installation by unauthorized parties, water intrusion, electrical damage, or tampering is not covered.

#2 – Subscription Terms and Late Payments

Subscription Services

The monthly subscription includes:

  • Access to the GPS tracking platform.
  • Mobile data for the SIM card to keep the tracker online.
  • Basic technical support during business hours.

 

Billing Cycle
Subscriptions are billed monthly in advance. Standard payment is due by the first of each month, unless otherwise agreed upon in writing.
For new installations, billing may begin based on the installation date, as the SIM data plan is activated on that date.

Late Payments
If payment is not received by the 5th of the month, the customer’s platform access will be suspended, although the tracker will remain active in the background.

Service Suspension
If payment is still not received by the 10th of the month, the SIM data will be disabled, causing the tracker to stop reporting. No refunds or credits will be issued for downtime caused by payment delays.

Reactivation Fee and Delay
A reactivation fee of $500 GYD Per Device may apply to restore services after suspension. Reactivation may take up to 24 hours after full payment is received and processed.

Account Termination
Accounts that remain unpaid for 30 days or more may be permanently terminated. SIM cards may be deactivated, and server access revoked. A new subscription will be required to restore service.

No Refund Policy
Subscription payments are non-refundable, including situations where the customer discontinues use or switches to another provider before the subscription period ends.

#3 – Customer Responsibilities and Acceptable Use

Device Care and Handling
Customers are responsible for ensuring that the GPS device is not tampered with, physically damaged, or removed without proper authorization. Damage caused by negligence, accidents, or unauthorized modifications will void any warranty and may incur additional charges for repair or reinstallation.

Use of Service
The tracking service is intended solely for lawful purposes. Customers agree not to use the service for any illegal, abusive, or unauthorized monitoring activities.

SIM and Server Use
The SIM and server access provided are strictly for use with the GPS device installed by GPSGY. Customers must not attempt to reuse the SIM in other devices or connect third-party tools to the server.

Data Privacy and Access
Customers are responsible for keeping their account credentials secure. Any unauthorized access to the platform resulting from weak or shared credentials is the responsibility of the customer. If unauthorized access is suspected, the customer must notify GPSGY immediately.

Location Accuracy Disclaimer
GPS accuracy may vary based on terrain, network coverage, building interference, or other environmental conditions. While every effort is made to provide accurate real-time tracking, GPSGY does not guarantee 100% precision at all times.

Compliance with Installation Requirements
Customers must ensure that their vehicle or asset meets the minimum requirements for installation. If a remote shutdown feature is requested, compatibility will be assessed in advance; availability is not guaranteed for all models.

#4 – Warranty and Support

Device Warranty
All GPS devices come with a 6 month limited warranty covering manufacturing defects only. The warranty begins on the date of installation or handover, whichever comes first.

Exclusions from Warranty
The warranty does not cover:

  • Damage due to misuse, neglect, or improper handling.
  • Damage caused by unauthorized installation or tampering.
  • Water damage, electrical surges, or short circuits.
  • Physical impact or removal attempts by untrained personnel.

Support Services
Basic technical support is provided during standard business hours (Monday–Friday, 9:00 AM – 5:00 PM). Support is available via [email protected].

Out-of-Warranty Service
For devices outside the warranty period or where warranty is voided, customers may request service at standard repair or replacement rates.

Warranty Claim Process
All warranty claims must be submitted in writing with a clear description of the issue. A technician will inspect the unit before any repair, replacement, or service is approved under warranty.

#5 – Cancellation and Termination

Customer-Initiated Cancellation
Customers may cancel their subscription at any time by providing at least 5 days’ notice before the next billing cycle. Cancellations must be submitted in writing or through an official company communication channel.

No Refunds for Early Cancellation
If a subscription is canceled mid-month, no refund or credit will be issued for unused days. The service will remain active until the end of the paid period.

Company-Initiated Termination
GPSGY reserves the right to suspend or terminate service without notice for:

  • Breach of terms and conditions.
  • Illegal use of the service.
  • Abuse of support services or staff.
  • Extended non-payment (30 days or more).

 

Data Retention after Termination
After termination, customer tracking data may be retained for up to 7 days and then permanently deleted. Reactivation after this point may require a new device registration.

SIM and Server Deactivation
Upon cancellation or termination, SIM data services will be permanently deactivated, and access to the tracking platform will be revoked.

Rejoining Service
Customers wishing to return after cancellation may be required to pay a reconnection/setup fee and clear any outstanding balances.

 

#6 – Limitation of Liability & Indemnification

Limitation of Liability
GPSGY shall not be liable for any direct, indirect, incidental, or consequential damages arising from:

  • Inaccurate GPS location reporting.
  • Network or system outages.
  • SIM provider disruptions.
  • Unauthorized use or tampering by third parties.
  • Failure of the customer to comply with installation or usage guidelines.

Service Availability
While we aim to provide 99% uptime, service availability may be affected by maintenance, provider outages, or technical issues beyond our control. We are not responsible for losses incurred due to temporary service interruptions.

Vehicle or Asset Loss
The GPS tracking system is a tool to assist with monitoring and security, but it does not guarantee prevention of theft or loss. GPSGY is not liable for any damages, loss of vehicles/assets, or related expenses.

Maximum Liability Cap
In any event, the total liability of GPSGY—whether in contract, tort, or otherwise—shall not exceed the total amount paid by the customer in subscription fees over the previous three (3) months.

Indemnification
Customers agree to indemnify, defend, and hold harmless GPSGY, its employees, and affiliates from any claims, damages, liabilities, or legal expenses arising from misuse of the service, violation of these terms, or breach of law in connection with the tracker’s use.

#7 – General Terms and Governing Law

Entire Agreement
These Terms and Conditions constitute the entire agreement between GPSGY and the customer regarding the sale, installation, and subscription services related to GPS tracking devices. Any verbal agreements or prior communications are superseded by this document.

Modifications to Terms
GPSGY reserves the right to update or modify these Terms and Conditions at any time. Changes will be communicated via email, WhatsApp, or official notice on our website or platform. Continued use of the service after updates implies acceptance.

Severability
If any clause in these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

Force Majeure
We shall not be held liable for any delay or failure to perform our obligations due to circumstances beyond our control, including but not limited to natural disasters, power outages, wars, strikes, or telecommunications failures.

Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Co-operative Republic of Guyana. Any disputes arising shall be resolved in the courts located within Guyana, unless otherwise agreed in writing.
